Child Endangerment Causing Bodily Injury

A Waterloo man on trial for significantly injuring his infant son has been convicted of a lesser charge. 25 year old Devin Toler Sr. was initially charged with Child Endangerment- Multiple Acts, but a jury found him guilty of Child Endangerment Causing Bodily Injury. The prosecution argued that Toler was responsible for the child receiving a broken leg, a broken arm, a broken rib, a broken toe, bleeding eyes, bleeding mouth, and scratches around the ear. During interviews with police Toler suggested those injuries happened while swaddling and diaper changes. The defense argued the baby’s mother may have been responsible for the injuries. They noted she was the primary caregiver and had told hospital staff that her dog had jumped on the baby. The defense also produced a text the mother had sent to a friend saying she hurt her arm falling down the stairs while carrying the baby. The mom denied sending that text in her testimony. Toler will be sentenced at a later date.
