A Clarksville man accused of killing a bicyclist has been acquitted, according to KIMT. 45 year old Colby Elliott was charged with Homicide by Vehicle- Reckless Driving in the death of 24 year old Ellen Bengston on August 2nd of 2020. Prosecutors argued that Elliott was distracted as he opened an app on his cell phone to read a message as he drove along T-64 in Floyd County. Bengston was riding outside the white fog line when she was struck by Elliott’s pickup and knocked into the west ditch. She later died of her injuries. Elliott’s attorney asked the judge to acquit saying the evidence against Elliott could not support a conviction even when viewed in the most favorable light for the prosecution. The judge agreed and ordered the state to pay court costs.
