Court Rules Against Waterloo Schools

The Iowa Supreme Court has ruled in favor of an insurance company, saying they are not responsible for paying for the rebuilding of Lowell Elementary School in Waterloo, according to the Waterloo Cedar Falls Courier. The roof of the school collapsed during a snow day in 2019. Employers Mutual Casualty Company paid $1.71 million to replace the collapsed roof, but refused to pay for the entire rebuild saying that was outside the scope of the policy. The Supreme Court agreed, saying to hold the insurance company responsible would have turned the insurance policy into a general maintenance contract. The school had to be rebuilt after the structure was deemed unsafe to occupy due to deteriorating mortar. The school district was asking for $19 million from Employers Mutual. The new Lowell building opened in 2022.
