A certified nursing assistant that was fired from the Tripoli Nursing and Rehabilitation Center in August has been granted unemployment benefits, according to the Iowa Capital Dispatch. Susan McMullen was fired after ignoring residents’ call lights, not starting her work until 49 minutes after she had clocked in and remaining on break for more than 100 minutes. Administrative Law Judge Blair Bennett ultimately ruled that McMullen was eligible for unemployment benefits because the incident that led to her firing, the excessive breaks, did not constitute disqualifying misconduct because she had not been previously warned about such behavior.
