A Gilbertville man has been arrested for allegedly stalking a Black Hawk County Judge, according to the Waterloo Cedar Falls Courier. Black Hawk County Sheriff’s deputies say that 39 year old Kyle Roberts began fixating on Associate Court Judge Michelle Wagner a decade ago, when she was an assistant county attorney and prosecuted Roberts’ first stalking case. In that case he stalked a neighbor in Raymond. He was sentenced to prison time before being released in 2017. Roberts appealed his conviction, seeking more than $62,000 for unlawful imprisonment and asking for the return of .22 caliber Marlin rifle and a Red Ryder BB gun. Earlier this year the Iowa Court of Appeals ruled against him. He then allegedly began sending messages to the Waterloo Police Department saying he would ruin the judge’s career and would damage vehicles in the police department parking lot. He then allegedly sent a message to the County Treasurer’s Office that had a “disparaging sexual connotation against the judge”. On August 28th he filed a document with the court saying he would sue the judge, calling her a derogatory name, and threatened that “something would happen” if the case was not brought to a jury. Roberts has been charged with second offense Stalking.
