A man that was shot by Waterloo Police more than two years ago has now been arrested for the incident, according to the Waterloo Cedar Falls Courier. Police were called on a report of a man walking with a rifle on the night of April 7th of 2021. When police arrived on scene the man, identified as Marcelino Alvarez Victoriano, allegedly began pointing the gun at the officers. One officer tried to run Alvarez over before Officer CJ Nichols shot him. Alvarez survived but was left paralyzed from the waist down. Police discovered the gun was a Red Ryder BB gun after the shooting. The Iowa Division of Criminal Investigation reviewed the shooting and determined Nichols acted reasonably and charged Alvarez with two counts of Assault on an Officer. The warrant remained unserved for two years until Thursday. Alvarez has filed a lawsuit against Nichols and the city of Waterloo alleging Negligence and Excessive Force.
