A Hazelton man convicted of fondling a 9 year old boy in 2016 has had his call for a new trial turned down, according to the Waterloo Cedar Falls Courier. 39 year old Joseph Banks faulted his attorney for not introducing online gaming records that Banks says show he was playing Rainbow Six and Grand Theft Auto on his Playstation at the time of alleged crimes and therefore he could not have committed them. The judge overseeing the appeal said that even with Banks’ attorney “failing to answer the Call of Duty,” a reference to another video game, Banks did not prove that he deserved a new trial. The court used the fact that Banks had not used the game log evidence in earlier appeals as proof that it was not the fault of his counsel. Banks was sentenced to up to 10 years in prison and will have to register as a sex offender for life.
