The City of Waterloo has reached a settlement with the family of a man shot to death by a police officer in November of 2021, according to KWWL. Brent Boggess led police on a chase in his Chevrolet Silverado in the early morning hours of November 16th. The chase went through yards and even a waterway. Boggess eventually hit a police cruiser at 8 miles per hour which prompted Officer Kenneth Schaaf to shoot Boggess through his open driver’s side window. Boggess died of his wounds. His family argued that the police were unjustified in their use of deadly force on an unarmed person suffering from a mental health episode. The case went all the way to the Iowa Supreme Court, which ruled that a state immunity law does not protect the City and Officer Schaaf from common law tort claims filed by the family. Boggess’ wife and three children will receive a total of $3million as part of the settlement.
