The person shot by police in Waterloo after an alleged drive by shooting has been arrested after being released from the hospital, according to the Waterloo Cedar Falls Courier. 22 year old Deandrew Spates of Waterloo was the front seat passenger of a Lincoln MKZ on September 16th. Neighbors told police he had opened fire on a home in the area of Western Avenue and West Third Street. Shortly after the shooting police pulled the MKZ over. They removed Spates from the vehicle and began to pat him down when he ran away. Police say as he ran away he tossed a handgun with a 50 round drum. It is unclear at which point the officer fired on Spates. Spates was taken to a local hospital before being transferred to the University of Iowa Hospitals and Clinics. He has now been charged with Felon in Possession of a Firearm and Interference While Armed. Spates was banned from possessing guns after being charged in a shooting in July of 2021 that injured a 5 year old girl. The Iowa Division of Criminal Investigation is investigating the officer involved shooting.
